1. Definitions

For the purposes of these Terms of Service ("Terms"), the following definitions apply:

  • "Owlivion" (also referred to as "we," "us," or "our") means the company that develops and distributes OwlMail.
  • "OwlMail" (also referred to as "the Application" or "the Software") means the desktop email client application developed by Owlivion, built on the Tauri v2 framework.
  • "User" (also referred to as "you" or "your") means any individual or entity that downloads, installs, or uses OwlMail.
  • "Service" means the OwlMail application together with any related services, including but not limited to Owlivion Sync, updates, documentation, and technical support.
  • "Owlivion Sync" means the optional cross-device synchronization service provided by Owlivion.
  • "Third-Party Services" means external services accessed through or in connection with OwlMail, including email providers, OAuth providers, and AI services.
  • "User Data" means any data stored, processed, or transmitted through the Application, including email content, account credentials, application settings, and preferences.
  • "Open Source Components" means the portions of OwlMail source code licensed under the MIT License and publicly available on GitHub.

2. Acceptance of Terms

By downloading, installing, accessing, or using OwlMail, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not download, install, or use the Application. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of such modifications.

Important: These Terms constitute a legally binding agreement between you and Owlivion. Please read them carefully before using OwlMail.

3. Description of Service

OwlMail is a privacy-focused, open-source desktop email client built on Tauri v2. The Application provides the following features:

  • Multi-Account Email Management: Connect and manage multiple email accounts via IMAP/SMTP protocols.
  • OAuth Authentication: Secure sign-in through Google OAuth 2.0 and Microsoft OAuth for supported email providers.
  • AI-Powered Phishing Detection: Automated analysis of incoming emails using Google Gemini AI to identify potential phishing threats.
  • Tracking Pixel Blocker: Detection and blocking of tracking pixels embedded in emails to protect your privacy.
  • Local Encryption: AES-256-GCM encryption for locally stored data, including account credentials and sensitive information.
  • Cross-Device Sync (Optional): Owlivion Sync service for synchronizing account settings, contacts, preferences, and signatures across devices.
  • AI Reply Suggestions: Optional AI-powered email reply generation using supported AI providers.

The Application is distributed as open-source software under the MIT License. Source code is available at github.com/owlivion-tech/owlmail.

4. User Eligibility

To use OwlMail, you must:

  • Be at least 13 years of age (or the minimum age required by applicable law in your jurisdiction).
  • If you are under 18 years of age (or the age of majority in your jurisdiction), have obtained parental or guardian consent.
  • Have the legal capacity to enter into a binding agreement.
  • Not be prohibited from using the Service under the laws of your jurisdiction.
  • Not have been previously suspended or removed from the Service for violation of these Terms.

By using OwlMail, you represent and warrant that you meet all of the foregoing eligibility requirements.

5. User Account and Security

5.1 Email Account Credentials

When you configure email accounts within OwlMail, your credentials (IMAP/SMTP passwords, OAuth tokens) are stored locally on your device, encrypted using AES-256-GCM. Owlivion does not have access to your email account passwords.

5.2 Owlivion Sync Account

If you choose to use Owlivion Sync, you may be required to create an Owlivion account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5.3 Security Responsibilities

You agree to:

  • Maintain the security of your device and operating system.
  • Keep your account credentials confidential and not share them with third parties.
  • Notify Owlivion immediately at security@owlivion.com if you become aware of any unauthorized access to your account.
  • Use strong, unique passwords for your Owlivion Sync account.

5.4 OAuth Connections

When you connect email accounts via Google OAuth or Microsoft OAuth, you authorize OwlMail to access your email data as permitted by the respective OAuth scopes. You may revoke this access at any time through your Google or Microsoft account settings.

6. User Obligations and Acceptable Use

You agree to use OwlMail only for lawful purposes and in accordance with these Terms. Specifically, you shall not:

  • Use the Application to send spam, unsolicited bulk email, or any form of unauthorized mass communication.
  • Use the Application to distribute malware, viruses, or other harmful software.
  • Attempt to gain unauthorized access to other users' accounts, systems, or networks.
  • Use the Application in violation of any applicable local, national, or international law or regulation.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Service or its related systems.
  • Use the AI features to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Circumvent, disable, or otherwise interfere with any security-related features of the Application.
  • Use the Application for any purpose that violates the terms of service of connected email providers (Gmail, Outlook, etc.).

Owlivion reserves the right to suspend or terminate access to Owlivion Sync services for any User who violates these obligations.

7. Intellectual Property

7.1 Open Source License

The OwlMail application source code is released under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, subject to the conditions of the MIT License. The full license text is available in the project repository at github.com/owlivion-tech/owlmail.

7.2 Owlivion Brand and Trademarks

The Owlivion name, OwlMail name, Owlivion logo, OwlMail logo, and all related brand assets, trade dress, and visual identity elements are the exclusive property of Owlivion and are not covered by the MIT License. You may not use these trademarks without prior written consent from Owlivion, except as required for reasonable and customary use in describing the origin of the Software (e.g., "based on OwlMail").

7.3 User Content

You retain all rights to your email content and data. Owlivion does not claim any ownership interest in your User Data. By using Owlivion Sync, you grant Owlivion a limited license to store and transmit your encrypted data solely for the purpose of providing the synchronization service.

8. Third-Party Services

OwlMail integrates with the following third-party services:

  • Google Gmail API: For managing Gmail accounts via IMAP and OAuth 2.0 authentication. Subject to Google's Terms of Service.
  • Google Gemini AI: For phishing detection and AI-powered reply suggestions. Subject to Google AI Terms of Service.
  • Microsoft OAuth: For managing Outlook/Microsoft email accounts. Subject to Microsoft Services Agreement.
  • Email Providers: Any IMAP/SMTP email provider (Gmail, Outlook, Yahoo, iCloud, etc.) connected through the Application is subject to its own terms and policies.

Owlivion is not responsible for the availability, accuracy, or practices of any third-party services. Your use of third-party services is governed by the respective terms and privacy policies of those services. Owlivion disclaims all liability arising from your use of or reliance on any third-party service.

9. Privacy and Data

Your privacy is fundamental to OwlMail's design. For comprehensive information about how we collect, use, and protect your data, please refer to our Privacy Policy.

Core Principle: Your data is stored locally on your device. We do not send your email content to our servers. Zero telemetry, zero tracking.

Key data practices:

  • Local-First Architecture: All email data, credentials, and settings are stored locally on your device with AES-256-GCM encryption.
  • Google OAuth: When connecting a Gmail account, OwlMail uses Google OAuth 2.0. Your Google password is never seen or stored by Owlivion.
  • AI Phishing Detection: Only the sender address and subject line are sent to Gemini AI for analysis. Email body content is not transmitted. This feature can be disabled.
  • Owlivion Sync: If enabled, data is encrypted with AES-256-GCM before transmission. The server stores only ciphertext; content cannot be read server-side.

For users in the European Economic Area (EEA), we comply with the General Data Protection Regulation (GDPR). For users in Turkey, we comply with the Personal Data Protection Law No. 6698 (KVKK). For details, see our KVKK Policy.

10. AI Features Disclaimer

OwlMail includes AI-powered features, including phishing detection and reply suggestions, powered by Google Gemini AI. You acknowledge and agree that:

  • AI-generated results are provided on an informational basis only and should not be solely relied upon for security decisions.
  • Phishing detection may produce false positives (legitimate emails flagged as threats) or false negatives (phishing emails not detected).
  • AI-generated reply suggestions are machine-generated and may contain inaccuracies, inappropriate content, or errors. You are solely responsible for reviewing and approving any AI-generated content before sending.
  • The quality and availability of AI features depend on third-party AI providers and may change without notice.
  • When using AI features, limited email metadata (sender address, subject line) may be transmitted to the AI provider. Refer to Section 9 and our Privacy Policy for details.
  • Owlivion does not guarantee the accuracy, reliability, or completeness of any AI-generated output.

11. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, Owlivion expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • Any warranty regarding the accuracy or reliability of AI-powered features, including phishing detection and reply suggestions.
  • Any warranty that the Application will be compatible with all email providers, operating systems, or hardware configurations.
  • Any warranty regarding the availability, performance, or reliability of Owlivion Sync or any third-party services.

You use the Application at your own risk. Owlivion does not warrant that the Application will meet your requirements or expectations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OWLIVION, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of data, emails, or email delivery failures.
  • Service interruptions or downtime of third-party email providers.
  • Damages arising from false positive or false negative results of the AI phishing detection system.
  • Loss of data on the User's device, including due to software malfunction, hardware failure, or operating system updates.
  • Damages resulting from unauthorized access to User accounts where the User failed to maintain adequate security measures.
  • Loss of profits, revenue, goodwill, or any other intangible losses.
  • Damages arising from the use of or inability to use the Service.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, Owlivion's liability shall be limited to the maximum extent permitted by law. In no event shall Owlivion's total aggregate liability exceed the amount paid by you, if any, for use of the Service during the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Owlivion, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Application.
  • Your violation of any provision of these Terms.
  • Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
  • Your violation of any applicable law, rule, or regulation.
  • Any content sent or transmitted through OwlMail from your account.
  • Any claim that content you transmitted through the Application caused damage to a third party.

This indemnification obligation shall survive the termination of these Terms and your use of the Application.

14. Account Termination and Data Deletion

14.1 Voluntary Termination

You may stop using OwlMail at any time by uninstalling the Application. As OwlMail is a local-first application, uninstalling will remove all locally stored data.

14.2 Owlivion Sync Account Deletion

If you use Owlivion Sync, you may permanently delete your sync account via Settings > Account > Delete Account. Upon deletion, all synchronized data stored on Owlivion servers will be permanently and irreversibly removed.

14.3 OAuth Revocation

To revoke OwlMail's access to your Google account, visit Google Account Permissions. To revoke Microsoft OAuth access, visit your Microsoft Account Privacy Settings.

14.4 Termination by Owlivion

Owlivion reserves the right to suspend or terminate your access to Owlivion Sync services, with or without notice, if you violate these Terms or engage in conduct that Owlivion reasonably determines is harmful to other users, Owlivion, or third parties. The local application will continue to function independently of any sync service suspension.

14.5 Effect of Termination

Upon termination, your right to use Owlivion Sync will cease immediately. Sections 7, 11, 12, 13, 16, 17, and 18 shall survive any termination of these Terms.

15. Modifications to Terms

Owlivion reserves the right to modify these Terms at any time. When changes are made:

  • The "Last updated" date at the top of this page will be revised.
  • Material changes will be communicated via in-app notification or through the OwlMail website.
  • For significant changes, we will endeavor to provide at least thirty (30) days' advance notice before the changes take effect.

Your continued use of the Application after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Application.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

16.2 Jurisdiction

For users located in Turkey, any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Republic of Turkey.

16.3 International Users

For users located outside of Turkey, the parties agree to first attempt to resolve any dispute through good-faith negotiation. If the dispute cannot be resolved within sixty (60) days, either party may submit the dispute to binding arbitration under the rules of the Istanbul Arbitration Centre (ISTAC). The seat of arbitration shall be Istanbul, Turkey. The language of arbitration shall be English.

16.4 Consumer Protection

Nothing in these Terms shall affect the statutory rights of consumers under mandatory consumer protection laws of their jurisdiction. If you are a consumer in the European Union, you may also raise your dispute through the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16.5 Turkish Consumer Law

For consumers in Turkey, the provisions of Turkish Consumer Protection Law No. 6502 and related regulations shall apply. Disputes may also be referred to the relevant Consumer Arbitration Committee (Tuketici Hakem Heyeti) for claims below the statutory threshold.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect. The failure of Owlivion to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18. Entire Agreement

These Terms, together with the Privacy Policy and the KVKK Policy, constitute the entire agreement between you and Owlivion with respect to the use of the Application and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and Owlivion regarding the Application.

Notwithstanding the foregoing, the MIT License governs the use, modification, and distribution of the open-source components of OwlMail and is not superseded by these Terms.

Bu Kullanim Kosullari ("Kosullar") kapsaminda asagidaki tanimlar gecerlidir:

  • "Owlivion" (ayni zamanda "biz" veya "bizim" olarak anilir), OwlMail'i gelistiren ve dagitan sirketi ifade eder.
  • "OwlMail" (ayni zamanda "Uygulama" veya "Yazilim" olarak anilir), Owlivion tarafindan gelistirilen, Tauri v2 cercevesi uzerinde insa edilmis masaustu e-posta istemcisi uygulamasini ifade eder.
  • "Kullanici" (ayni zamanda "siz" veya "sizin" olarak anilir), OwlMail'i indiren, yukleyen veya kullanan herhangi bir birey veya tuzel kisiyi ifade eder.
  • "Hizmet", OwlMail uygulamasi ile birlikte Owlivion Sync, guncellemeler, belgeler ve teknik destek dahil olmak uzere ilgili tum hizmetleri ifade eder.
  • "Owlivion Sync", Owlivion tarafindan saglanan istege bagli cihazlar arasi senkronizasyon hizmetini ifade eder.
  • "Ucuncu Taraf Hizmetler", OwlMail araciligiyla veya OwlMail ile baglantili olarak erisilebilen e-posta saglayicilari, OAuth saglayicilari ve AI hizmetleri dahil harici hizmetleri ifade eder.
  • "Kullanici Verileri", Uygulama araciligiyla saklanan, islenen veya iletilen e-posta icerigi, hesap kimlik bilgileri, uygulama ayarlari ve tercihler dahil tum verileri ifade eder.
  • "Acik Kaynak Bilesenleri", MIT Lisansi altinda lisanslanan ve GitHub uzerinde kamuya acik olan OwlMail kaynak kodu bolumlerini ifade eder.

2. Kosullarin Kabulu

OwlMail'i indirerek, yukleyerek, erisim saglayarak veya kullanarak bu Kosullari okudugunuzu, anladiginizi ve bunlara bagli olmayi kabul ettiginizi beyan etmis olursunuz. Bu Kosullari bir kurum adina kabul ediyorsaniz, o kurumu bu Kosullara baglama yetkinize sahip oldugunuzu beyan ve garanti edersiniz.

Bu Kosullari kabul etmiyorsaniz, Uygulamayi indirmemeli, yuklemeyemeli veya kullanmamalisiniz. Bu Kosullarda yapilan herhangi bir degisiklikten sonra Hizmeti kullanmaya devam etmeniz, soz konusu degisiklikleri kabul ettiginiz anlamina gelir.

Onemli: Bu Kosullar, siz ve Owlivion arasinda hukuken baglayici bir sozlesme olusturur. Lutfen OwlMail'i kullanmadan once dikkatlice okuyunuz.

3. Hizmet Tanimi

OwlMail, Tauri v2 uzerinde insa edilmis, gizlilik odakli, acik kaynakli bir masaustu e-posta istemcisidir. Uygulama asagidaki ozellikleri sunar:

  • Coklu Hesap Yonetimi: IMAP/SMTP protokolleri uzerinden birden fazla e-posta hesabini baglama ve yonetme.
  • OAuth Kimlik Dogrulamasi: Desteklenen e-posta saglayicilari icin Google OAuth 2.0 ve Microsoft OAuth ile guvenli oturum acma.
  • AI Destekli Phishing Tespiti: Potansiyel phishing (oltalama) tehditlerini belirlemek icin Google Gemini AI kullanarak gelen e-postalarin otomatik analizi.
  • Takip Pikseli Engelleme: Gizliliginizi korumak icin e-postalara gomulu takip piksellerinin tespit edilmesi ve engellenmesi.
  • Yerel Sifreleme: Hesap kimlik bilgileri ve hassas bilgiler dahil yerel olarak saklanan veriler icin AES-256-GCM sifreleme.
  • Cihazlar Arasi Senkronizasyon (Istege Bagli): Hesap ayarlari, kisiler, tercihler ve imzalari cihazlar arasinda senkronize etmek icin Owlivion Sync hizmeti.
  • AI Yanit Onerileri: Desteklenen AI saglayicilari kullanilarak istege bagli AI destekli e-posta yanit olusturma.

4. Kullanici Uygunlugu

OwlMail'i kullanmak icin:

  • En az 13 yasinda (veya bulundugunuz yargi alanindaki yururlukteki yasalarin gerektirdigi asgari yasta) olmalisiniz.
  • 18 yasindan kucukseniz (veya bulundugunuz yargi alanindaki resite erme yasindan kucukseniz), ebeveyn veya veli onayini almis olmalisiniz.
  • Baglayici bir sozlesme yapma hukuki ehliyetine sahip olmalisiniz.
  • Bulundugunuz yargi alaninin yasalari kapsaminda Hizmeti kullanmaniz yasaklanmamis olmalidir.
  • Bu Kosullarin ihlali nedeniyle daha once Hizmetten askiya alinmamis veya cikarilmamis olmalisiniz.

OwlMail'i kullanarak, yukarida belirtilen tum uygunluk gereksinimlerini karsiladiginizi beyan ve garanti etmis olursunuz.

5. Kullanici Hesabi ve Guvenlik

5.1 E-posta Hesap Kimlik Bilgileri

OwlMail icerisinde e-posta hesaplari yapilandirdiginizda, kimlik bilgileriniz (IMAP/SMTP sifreleri, OAuth tokenlari) AES-256-GCM ile sifrelenerek cihazinizda yerel olarak saklanir. Owlivion, e-posta hesap sifrelerinize erisim saglamaz.

5.2 Owlivion Sync Hesabi

Owlivion Sync'i kullanmayi tercih ederseniz, bir Owlivion hesabi olusturmaniz gerekebilir. Hesap kimlik bilgilerinizin gizliligini korumak ve hesabiniz altinda gerceklestirilen tum faaliyetlerden siz sorumlusunuz.

5.3 Guvenlik Sorumluluklari

Asagidaki hususlari kabul etmis sayilirsiniz:

  • Cihazinizin ve isletim sisteminizin guvenligini saglamak.
  • Hesap kimlik bilgilerinizi gizli tutmak ve ucuncu taraflarla paylasmamak.
  • Hesabiniza yetkisiz erisimden haberdar olmaniz halinde derhal security@owlivion.com adresine bildirimde bulunmak.
  • Owlivion Sync hesabiniz icin guclu ve benzersiz sifreler kullanmak.

5.4 OAuth Baglantilari

E-posta hesaplarini Google OAuth veya Microsoft OAuth araciligiyla bagladiginizda, OwlMail'in ilgili OAuth kapsamlari tarafindan izin verilen sekilde e-posta verilerinize erismesine yetki vermis olursunuz. Bu erisimi istediginiz zaman Google veya Microsoft hesap ayarlariniz uzerinden iptal edebilirsiniz.

6. Kullanici Yukumlulukleri ve Kabul Edilebilir Kullanim

OwlMail'i yalnizca yasalara uygun amaclarla ve bu Kosullara uygun olarak kullanmayi kabul edersiniz. Ozellikle asagidakileri yapmamalisiniz:

  • Uygulamayi spam, istenmeyen toplu e-posta veya herhangi bir yetkisiz toplu iletisim gondermek icin kullanmak.
  • Uygulamayi zararli yazilim, virus veya diger zararli yazilim dagitmak icin kullanmak.
  • Diger kullanicilarin hesaplarina, sistemlerine veya aglarina yetkisiz erisim saglamaya calismak.
  • Uygulamayi gecerli herhangi bir yerel, ulusal veya uluslararasi yasa veya yonetmeligi ihlal ederek kullanmak.
  • Herhangi bir kisi veya kurumu taklit etmek veya herhangi bir kisi veya kurumla iliskinizi yanlis beyan etmek.
  • Hizmetin veya ilgili sistemlerin butunlugunu veya performansini bozmak veya engellemek.
  • AI ozelliklerini yasadisi, zararli, tehditkâr, kotu niyetli, taciz edici, iftira niteliginde veya baska sekilde sakincali icerik olusturmak icin kullanmak.
  • Uygulamanin guvenlikle ilgili ozelliklerini atlatmak, devre disi birakmak veya baska sekilde mudahale etmek.
  • Uygulamayi, bagli e-posta saglayicilarinin (Gmail, Outlook vb.) hizmet kosullarini ihlal eden herhangi bir amacla kullanmak.

Owlivion, bu yukumlulukleri ihlal eden herhangi bir Kullanicinin Owlivion Sync hizmetlerine erisimini askiya alma veya sonlandirma hakkini sakli tutar.

7. Fikri Mulkiyet

7.1 Acik Kaynak Lisansi

OwlMail uygulama kaynak kodu MIT Lisansi altinda yayinlanmistir. MIT Lisansi kosullarina tabi olarak Yazilimin kopyalarini kullanma, kopyalama, degistirme, birlestirme, yayinlama, dagitma, alt lisanslama ve/veya satma ozgurlugune sahipsiniz. Tam lisans metni github.com/owlivion-tech/owlmail proje deposunda mevcuttur.

7.2 Owlivion Markasi ve Ticari Markalar

Owlivion adi, OwlMail adi, Owlivion logosu, OwlMail logosu ve tum ilgili marka varliklari, ticari gorsel kimlik ogeleri Owlivion'un mustakar mulkiyetindedir ve MIT Lisansi kapsaminda degildir. Owlivion'dan onceden yazili izin almadan bu ticari markalari kullanamazsiniz; ancak Yazilimin kokenini tanimlamak icin makul ve adet olmus kullanim bunun disindadir (orn. "OwlMail tabanlidir").

7.3 Kullanici Icerigi

E-posta icerikleriniz ve verileriniz uzerindeki tum haklari muhafaza edersiniz. Owlivion, Kullanici Verileriniz uzerinde herhangi bir mulkiyet hakki talep etmez. Owlivion Sync'i kullanarak, yalnizca senkronizasyon hizmetini sunmak amaciyla sifrelenmis verilerinizi saklamak ve iletmek uzere Owlivion'a sinirli bir lisans vermis olursunuz.

8. Ucuncu Taraf Hizmetler

OwlMail asagidaki ucuncu taraf hizmetlerle entegre calismaktadir:

  • Google Gmail API: IMAP ve OAuth 2.0 kimlik dogrulamasi uzerinden Gmail hesaplarinin yonetimi. Google Hizmet Sartlari'na tabidir.
  • Google Gemini AI: Phishing tespiti ve AI destekli yanit onerileri. Google AI Hizmet Sartlari'na tabidir.
  • Microsoft OAuth: Outlook/Microsoft e-posta hesaplarinin yonetimi. Microsoft Hizmet Sozlesmesi'ne tabidir.
  • E-posta Saglayicilari: Uygulama araciligiyla baglanan herhangi bir IMAP/SMTP e-posta saglayicisi (Gmail, Outlook, Yahoo, iCloud vb.) kendi sartlarina ve politikalarina tabidir.

Owlivion, herhangi bir ucuncu taraf hizmetin kullanilabilirliginden, dogrulugu veya uygulamalarindan sorumlu degildir. Ucuncu taraf hizmetleri kullaniminiz, bu hizmetlerin ilgili sartlari ve gizlilik politikalarinca yonetilir. Owlivion, herhangi bir ucuncu taraf hizmeti kullaniminizdan veya bu hizmetlere guvenmenizden kaynaklanan tum sorumluluklari reddeder.

9. Gizlilik ve Veri

Gizliliginiz, OwlMail'in tasariminin temelini olusturur. Verilerinizi nasil topladigimiz, kullandigimiz ve korudugumuza iliskin kapsamli bilgi icin lutfen Gizlilik Politikamizi inceleyiniz.

Temel Prensip: Verileriniz yerel olarak cihazinizda saklanir. E-posta iceriklerinizi sunucularimiza gondermeyiz. Sifir telemetri, sifir izleme.

Temel veri uygulamalari:

  • Yerel Oncelikli Mimari: Tum e-posta verileri, kimlik bilgileri ve ayarlar AES-256-GCM sifreleme ile cihazinizda yerel olarak saklanir.
  • Google OAuth: Gmail hesabinizi baglarken OwlMail, Google OAuth 2.0 kullanir. Google sifreniz Owlivion tarafindan asla gorulmez veya saklanmaz.
  • AI Phishing Tespiti: Analiz icin yalnizca gonderen adresi ve konu satiri Gemini AI'a gonderilir. E-posta govde icerigi iletilmez. Bu ozellik devre disi birakilabilir.
  • Owlivion Sync: Etkinlestirildiginde, veriler iletimden once AES-256-GCM ile sifrelenir. Sunucu yalnizca sifrelenmis metin saklar; icerik sunucu tarafinda okunamaz.

Avrupa Ekonomik Alani'ndaki (AEA) kullanicilar icin Genel Veri Koruma Yonetmeligi'ne (GDPR) uygunluk sagliyoruz. Turkiye'deki kullanicilar icin 6698 Sayili Kisisel Verilerin Korunmasi Kanunu'na (KVKK) uygunluk sagliyoruz. Detaylar icin KVKK Politikamizi inceleyiniz.

10. AI Ozellikleri Sorumluluk Reddi

OwlMail, Google Gemini AI tarafindan desteklenen phishing tespiti ve yanit onerileri dahil AI destekli ozellikler icerir. Asagidakileri kabul ve beyan etmis sayilirsiniz:

  • AI tarafindan olusturulan sonuclar yalnizca bilgilendirme amacliyla saglnir ve guvenlik kararlari icin tek basina dayanak olarak alinmamalidir.
  • Phishing tespiti yanlis pozitif (meşru e-postalarin tehdit olarak isaretlenmesi) veya yanlis negatif (phishing e-postalarinin tespit edilememesi) sonuclar uretebilir.
  • AI tarafindan olusturulan yanit onerileri makine tarafindan uretilir ve yanlisliklar, uygunsuz icerik veya hatalar icerebilir. Gondermeden once AI tarafindan olusturulan herhangi bir icerigi incelemek ve onaylamak tamamen sizin sorumluluginizdadir.
  • AI ozelliklerinin kalitesi ve kullanilabilirligi ucuncu taraf AI saglayicilarina baglidir ve onceden bildirimde bulunulmaksizin degisebilir.
  • AI ozelliklerini kullanirken, sinirli e-posta meta verileri (gonderen adresi, konu satiri) AI saglayicisina iletilebilir. Detaylar icin Bolum 9 ve Gizlilik Politikamiza bakiniz.
  • Owlivion, AI tarafindan olusturulan herhangi bir ciktinin dogrulugununu, guvenilirligini veya tamlilisini garanti etmez.

11. Garanti Reddi

UYGULAMA "OLDUGU GIBI" VE "MEVCUT HALIYLE" HERHANGI BIR ACIK VEYA ZIMNI GARANTI OLMAKSIZIN SUNULMAKTADIR.

Yururlukteki yasalarin izin verdigi azami olcude, Owlivion acik, zimni, yasal veya baska turlerde olmak uzere asagidakiler dahil tum garantileri acikca reddeder:

  • Ticarete elverislilik, belirli bir amaca uygunluk ve ihlal etmeme konusundaki zimni garantiler.
  • Uygulamanin kesintisiz, hatasiz, guvenli veya virus ya da diger zararli bilesenlerden arinmis olacagina dair herhangi bir garanti.
  • Phishing tespiti ve yanit onerileri dahil AI destekli ozelliklerin dogrulugu veya guvenilirligi ile ilgili herhangi bir garanti.
  • Uygulamanin tum e-posta saglayicilari, isletim sistemleri veya donanim yapilandirmalariyla uyumlu olacagina dair herhangi bir garanti.
  • Owlivion Sync veya herhangi bir ucuncu taraf hizmetin kullanilabilirligi, performansi veya guvenilirligi ile ilgili herhangi bir garanti.

Uygulamayi kendi riskinizle kullanirsiniz. Owlivion, Uygulamanin gereksinimlerinizi veya beklentilerinizi karsilayacagini garanti etmez.

12. Sorumluluk Sinirlamasi

YURURLUKTEKI YASALARIN IZIN VERDIGI AZAMI OLCUDE, OWLIVION, YONETICILERI, CALISANLARI, ORTAKLARI, ACENTELERI, TEDARIKCULERI VEYA BAGLI KURULUSLARI HICBIR DURUMDA ASAGIDAKILER DAHIL ANCAK BUNLARLA SINIRLI OLMAMAK UZERE DOLAYLI, ARIZI, OZEL, SONUC OLARAK ORTAYA CIKAN VEYA CEZAI TAZMINATLARDAN SORUMLU OLMAYACAKTIR:

  • Veri kaybi, e-posta kaybi veya e-posta teslim basarisizliklari.
  • Ucuncu taraf e-posta saglayicilarinin hizmet kesintileri veya calisma durdurmalari.
  • AI phishing tespit sisteminin yanlis pozitif veya yanlis negatif sonuclarindan kaynaklanan zararlar.
  • Yazilim arizasi, donanim arizasi veya isletim sistemi guncellemeleri dahil olmak uzere Kullanicinin cihazindaki veri kaybi.
  • Kullanicinin yeterli guvenlik onlemleri almadigi durumlarda yetkisiz hesap erişiminden kaynaklanan zararlar.
  • Kar, gelir, itibar veya diger maddi olmayan kayiplar.
  • Hizmeti kullanmaktan veya kullanamamaktan kaynaklanan zararlar.

Sonuc olarak ortaya cikan veya arizi zararlarin sorumlulugunu sinirlandirma veya haric tutmanin yasaklandigi yargi alanlarinda, Owlivion'un sorumlulugu yasalarin izin verdigi azami olcude sinirli olacaktir. Hicbir durumda Owlivion'un toplam sorumlulugu, talebin dogmasina yol acan olaydan onceki on iki (12) ay boyunca Hizmetin kullanimi icin sizin tarafinizdan odenen tutari (varsa) asmayacaktir.

13. Tazminat

Asagidakilerden kaynaklanan her turlu talep, zarar, yukumluluk, kayip, sorumluluk, maliyet veya borc ve masrafa (avukatlik ucretleri dahil ancak bunlarla sinirli olmamak uzere) karsi Owlivion'u, yetkililerini, yoneticilerini, calisanlarini, acentelerini, lisans verenlerini ve tedarikçilerini savunmayi, tazmin etmeyi ve zararsiz tutmayi kabul edersiniz:

  • Uygulamaya erisiminiz ve kullaniniminiz.
  • Bu Kosullarin herhangi bir hukmiunu ihlal etmeniz.
  • Fikri mulkiyet, gizlilik veya mulkiyet hakki dahil herhangi bir ucuncu taraf hakkini ihlal etmeniz.
  • Gecerli herhangi bir yasa, kural veya yonetmeligi ihlal etmeniz.
  • Hesabiniz uzerinden OwlMail araciligiyla gonderilen veya iletilen herhangi bir icerik.
  • Uygulama araciligiyla ilettiginiz icerigin ucuncu bir tarafa zarar verdigi iddialari.

Bu tazminat yukumlulugu, bu Kosullarin sona ermesinden ve Uygulamayi kullaniminizin bitmesinden sonra da devam edecektir.

14. Hesap Sonlandirma ve Veri Silme

14.1 Gonullu Sonlandirma

Uygulamayi kaldirarak istediginiz zaman OwlMail'i kullanmayi birakabilirsiniz. OwlMail yerel oncelikli bir uygulama oldugundan, kaldirma islemi yerel olarak saklanan tum verileri silecektir.

14.2 Owlivion Sync Hesap Silme

Owlivion Sync kullaniyorsaniz, Ayarlar > Hesap > Hesabi Sil secenegi ile senkronizasyon hesabinizi kalici olarak silebilirsiniz. Silme isleminin ardindan, Owlivion sunucularinda saklanan tum senkronize veriler kalici ve geri donulemez sekilde kaldirilacaktir.

14.3 OAuth Iptali

OwlMail'in Google hesabiniza erisimini iptal etmek icin Google Hesap Izinleri'ni ziyaret ediniz. Microsoft OAuth erisimini iptal etmek icin Microsoft Hesap Gizlilik Ayarlari'ni ziyaret ediniz.

14.4 Owlivion Tarafindan Sonlandirma

Owlivion, bu Kosullari ihlal etmeniz veya Owlivion'un makul olarak diger kullanicilara, Owlivion'a veya ucuncu taraflara zararli olduguna karar verdigi bir davranista bulunmaniz durumunda, onceden bildirimde bulunarak veya bulunmadan Owlivion Sync hizmetlerine erisinizi askiya alma veya sonlandirma hakkini sakli tutar. Yerel uygulama, herhangi bir senkronizasyon hizmeti askiya almasidan bagimsiz olarak calismaya devam edecektir.

14.5 Sonlandirmanin Etkisi

Sonlandirma uzerine, Owlivion Sync'i kullanma hakkiniz derhal sona erecektir. Bolum 7, 11, 12, 13, 16, 17 ve 18, bu Kosullarin herhangi bir sekilde sona ermesinden sonra da yururlukte kalacaktir.

15. Kosullarda Degisiklik

Owlivion, bu Kosullari istediği zaman degistirme hakkini sakli tutar. Degisiklik yapildiginda:

  • Bu sayfanin ustundeki "Son guncelleme" tarihi revize edilecektir.
  • Onemli degisiklikler uygulama ici bildirim veya OwlMail web sitesi araciligiyla iletilecektir.
  • Onemli degisiklikler icin, degisikliklerin yururluge girmesinden en az otuz (30) gun once bildirimde bulunmaya calisacagiz.

Herhangi bir degisikligin yururluk tarihinden sonra Uygulamayi kullanmaya devam etmeniz, guncellenmis Kosullari kabul ettiginiz anlamina gelir. Degistirilen Kosullari kabul etmiyorsaniz, Uygulamayi kullanmayi birakmalisiniz.

16. Uygulanacak Hukuk ve Uyusmazlik Cozumu

16.1 Uygulanacak Hukuk

Bu Kosullar, kanunlar ihtilafi hukumleri dikkate alinmaksizin Turkiye Cumhuriyeti hukukuna tabi olacak ve buna gore yorumlanacaktir. Birlesmis Milletler Uluslararasi Mal Satis Sozlesmeleri Hakkinda Konvansiyon (CISG) hukumleri uygulanmayacaktir.

16.2 Yargi Yetkisi

Turkiye'de bulunan kullanicilar icin, bu Kosullardan kaynaklanan veya bunlarla baglantili herhangi bir uyusmazlik, Turkiye Cumhuriyeti Istanbul mahkemelerinin mustakar yetkisine tabi olacaktir.

16.3 Uluslararasi Kullanicilar

Turkiye disinda bulunan kullanicilar icin, taraflar once herhangi bir uyusmazligi iyi niyetli muzakere yoluyla cozmeye calismayi kabul ederler. Uyusmazlik altmis (60) gun icinde cozulemezse, taraflardan herhangi biri uyusmazligi Istanbul Tahkim Merkezi (ISTAC) kurallari kapsaminda baglayici tahkime sunabilir. Tahkim yeri Istanbul, Turkiye olacaktir. Tahkim dili Ingilizce olacaktir.

16.4 Tuketici Korumasi

Bu Kosullardaki hicbir husus, tuketicilerin kendi yargi alanlarindaki zorunlu tuketici koruma yasalari kapsamindaki yasal haklarini etkilemeyecektir. Avrupa Birligi'ndeki tuketiciler, uyusmazliklarini AB Cevrimici Uyusmazlik Cozumu platformu uzerinden de dile getirebilirler: ec.europa.eu/consumers/odr.

16.5 Turk Tuketici Hukuku

Turkiye'deki tuketiciler icin, 6502 Sayili Tuketicinin Korunmasi Hakkinda Kanun ve ilgili yonetmelik hukumleri uygulanacaktir. Yasal esigi altindaki talepler icin uyusmazliklar ilgili Tuketici Hakem Heyeti'ne de yonlendirilebilir.

17. Bolulebilirlik

Bu Kosullarin herhangi bir hukmu yetkili bir mahkeme tarafindan uygulanamaz veya gecersiz bulunursa, soz konusu hukum uygulanabilir kilmak icin gereken asgari olcude degistirilecek ve bu Kosullarin geri kalan hukumleri tam olarak yururlukte ve gecerli olmaya devam edecektir. Owlivion'un bu Kosullarin herhangi bir hak veya hukmunu uygulamamasi, soz konusu hak veya hukumden feragat ettiginin anlamine gelmez.

18. Sozlesmenin Tamami

Bu Kosullar, Gizlilik Politikasi ve KVKK Politikasi ile birlikte, Uygulamanin kullanimina iliskin siz ve Owlivion arasindaki sozlesmenin tamamini olusturur ve Uygulama hakkinda siz ve Owlivion arasindaki tum onceki veya es zamanli iletisimlerin, tekliflerin ve sozlesmelerin (elektronik, sozlu veya yazili) yerine gecer.

Yukaridaki hukme ragmen, MIT Lisansi, OwlMail'in acik kaynak bilesenlerinin kullanimini, degistirilmesini ve dagitimini yonetir ve bu Kosullar tarafindan gecersiz kilinmaz.

19. Iletisim Bilgileri

Bu Kullanim Kosullari hakkinda herhangi bir sorunuz, endişeniz veya talebiniz varsa lutfen bizimle iletisime geciniz:
